Terms of Use

These terms explain the rules for using Bloomfall and this website, including the license you receive, advertising, acceptable use, and service limitations.

Effective July 9, 2026

1. Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and the independent developer of Bloomfall (“Bloomfall,” “we,” “us,” or “our”). They apply to the Bloomfall mobile game, its content and services, and this website (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Additional terms from Apple, the App Store, your device platform, or a third-party service may also apply. If those terms conflict with these Terms, the third-party terms control only for that third-party service.

2. Who may use Bloomfall

You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Services where access is prohibited by applicable law.

3. Limited license

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Bloomfall on devices you own or control for your personal, non-commercial entertainment. No ownership of Bloomfall or its content is transferred to you.

4. Local data and scores

Bloomfall may store your name or nickname, gardener choice, settings, and personal top scores on your device. We do not guarantee that this data will always be available, recoverable, or compatible with every future version. Deleting the app, resetting a device, installing an update, or a technical failure may cause data loss.

Scores are gameplay records only. They have no cash value, are not property, cannot be transferred or redeemed outside Bloomfall, and may be adjusted or removed to preserve balance, fix errors, prevent abuse, or update the game.

5. Advertising and third-party services

Bloomfall may display banner and interstitial ads supplied by Google or other advertising partners. An ad may link to a third-party app, product, or website. We do not control and are not responsible for third-party content, availability, transactions, security, or privacy practices. Your dealings with an advertiser are between you and that advertiser.

6. Acceptable use and fair play

You agree not to:

  • use the Services for unlawful, fraudulent, or harmful activity;
  • cheat, manipulate scores, automate gameplay, or exploit bugs;
  • interfere with the Services, another player, or any connected network;
  • introduce malware or attempt to bypass security or access controls;
  • copy, sell, rent, distribute, modify, reverse engineer, or create derivative works from the Services except where applicable law expressly permits it; or
  • use Bloomfall’s name, artwork, code, audio, characters, or branding in a way that falsely suggests sponsorship or endorsement.

We may disregard scores, remove access to features, or suspend or end access to the Services when we reasonably believe these rules were violated or action is needed to protect the Services or other users.

7. Ownership

Bloomfall and the Services—including their software, game systems, visual design, artwork, characters, text, audio, branding, and other content—are owned by the developer or used under license and are protected by intellectual-property laws. All rights not expressly granted in these Terms are reserved. Third-party names and trademarks belong to their respective owners.

8. Feedback

If you voluntarily send ideas, suggestions, or feedback about Bloomfall, you give us permission to use, adapt, and incorporate that feedback without restriction or payment to you. This does not give us ownership of personal information included in your message; personal information remains subject to the Privacy Policy.

9. Updates, availability, and termination

We may update, balance, repair, replace, suspend, or discontinue any part of the Services. Features and device requirements may change. We do not promise that the Services, a particular feature, or an ad will be available at all times or in every location.

You may end this agreement at any time by stopping use and deleting the game. We may suspend or terminate your access if you materially violate these Terms, create risk or legal exposure, or if the Services are discontinued. Sections that by their nature should survive—such as ownership, disclaimers, liability limits, and dispute terms—remain in effect after termination.

10. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that locally stored settings or scores will never be lost, that defects will always be fixed, or that third-party services and ads will remain available.

Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions above apply only to the extent legally permitted.

11. Limitation of liability

To the fullest extent permitted by law, Bloomfall and its developer, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, scores, profits, goodwill, or opportunities, arising from or related to the Services.

To the fullest extent permitted by law, the total liability for all claims relating to the Services will not exceed the greater of the amount you paid directly for Bloomfall during the twelve months before the claim or US $25. These limits do not apply to liability that cannot legally be limited, and they do not reduce mandatory consumer rights.

12. Resolving disputes

Before starting a formal claim, please contact us and give us a reasonable opportunity to resolve the issue informally. These Terms do not require arbitration and do not waive any right that cannot be waived under applicable law. Any dispute will be handled under the laws and procedures that apply based on the parties and the claim, including any mandatory consumer protections where you live.

13. Changes to these terms

We may update these Terms to reflect changes to Bloomfall, third-party requirements, or law. The effective date at the top will identify the latest version. If a change is material, we will provide additional notice where reasonably practical or legally required. Continuing to use the Services after revised Terms take effect means you accept the revised Terms to the extent permitted by law.

14. General terms

If a provision of these Terms is found unenforceable, it will be limited or removed only as much as necessary, and the remaining terms will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer these Terms as part of a reorganization, financing, sale, or transfer of Bloomfall. These Terms and the Privacy Policy form the agreement between you and us regarding the Services.
